Terms and Conditions
1. Service and Rental Period
Waste Haul provides roll-off container rental, hauling, and disposal services. Service requests received by noon may be scheduled for the next business day, while same-day service may be available at Waste Haul's discretion. Containers are rented for a specified term, fee, and included tonnage allowance. Customer is responsible for requesting container removal when use is complete, as Waste Haul does not automatically remove containers at the end of the rental period. Additional rental days beyond the agreed term will be charged at the applicable daily rental rate plus taxes.
2. Acceptable Waste Materials
Containers may be used only for non-hazardous solid waste, construction debris, demolition debris, recyclable materials, and other materials approved by Waste Haul. Prohibited materials include hazardous, toxic, radioactive, biomedical, infectious, flammable, explosive, corrosive, volatile, petroleum-contaminated, asbestos-containing, industrial process, regulated medical, treated or de-characterized waste, waste tires, and any material prohibited by law. Appliances containing refrigerants may only be accepted if Customer provides documentation confirming proper refrigerant removal. Household garbage may be accepted but may incur additional disposal charges depending on landfill requirements.
3. Inspection and Prohibited Waste
Waste Haul reserves the right to inspect, analyze, test, reject, or refuse any waste material. If prohibited waste is discovered, Waste Haul may refuse service, require Customer to remove the material, return it to Customer, or arrange disposal at Customer's expense. Customer is solely responsible for all costs, damages, environmental liabilities, penalties, fines, testing expenses, cleanup costs, and legal fees arising from prohibited materials placed in a container.
4. Weight Limits and Loading Requirements
Containers may not be loaded above the top edge and must comply with all legal transportation weight limits. Customer agrees to pay all applicable overweight disposal fees and transportation surcharges. Under no circumstances may a container exceed twelve (12) tons of material. Waste Haul reserves the right to refuse service on any overloaded, overweight, or unsafe container until corrected by Customer.
5. Trip Charges and Container Relocation
A Trip Charge may be assessed when Waste Haul cannot safely complete delivery, pickup, exchange, or service due to overloaded containers, overweight containers, blocked access, obstructed equipment, or unsafe site conditions. Trip Charges may be assessed at rates up to $165 per occurrence. Customer-requested relocation of a container may also be charged at rates beginning at $165 per occurrence, with additional charges based on distance, labor, and equipment requirements.
6. Equipment Ownership and Site Conditions
All containers and equipment remain the exclusive property of Waste Haul. Customer assumes responsibility for the container from delivery until removal, including loss, theft, fire, vandalism, misuse, or damage beyond normal wear and tear. Customer shall provide safe and reasonable access over surfaces capable of supporting Waste Haul's trucks and equipment and is responsible for identifying and protecting driveways, pavement, curbs, sidewalks, underground utilities, septic systems, sprinkler systems, landscaping, and other property. Waste Haul shall not be liable for damage resulting from normal delivery, placement, servicing, relocation, or removal operations.
7. Customer Responsibility for Waste
Customer represents that all materials placed in the container are lawfully owned or controlled by Customer and is solely responsible for the classification, legality, transportation, and disposal eligibility of all waste. Customer retains responsibility for all container contents and agrees to indemnify and hold harmless Waste Haul from any claims, losses, penalties, environmental liabilities, damages, costs, or expenses arising from the contents of the container.
8. Payment Terms
Unless approved credit terms have been established, payment is due in advance by credit card at the time of reservation. Waste Haul may retain payment information on file and charge any outstanding balance, including additional rental fees, excess tonnage charges, disposal fees, trip charges, relocation charges, taxes, processing fees, and any other amounts due under this agreement. Approved commercial accounts are due Net 30 days. Credit card payments on approved accounts are subject to a 3.5% processing fee. No processing fee applies to ACH payments, company checks, or personal checks.
9. Indemnification
Customer agrees to defend, indemnify, and hold harmless Waste Haul, its owners, employees, agents, and affiliates from any claims, liabilities, damages, fines, penalties, losses, costs, or expenses arising from Customer's use of the container, prohibited waste, violation of applicable laws, property damage, personal injury, environmental claims, or breach of these Terms and Conditions.
10. Acceptance of Terms
The individual placing the order represents and warrants that they have authority to bind the Customer to these Terms and Conditions. These Terms and Conditions apply to all rental transactions and are incorporated into all service agreements, quotations, invoices, work orders, reservations, and related documents.
